Please read this disclaimer carefully before using any free software application published by WheezyDoesit (“we”, “us”, “our”) on wheezydoesit.co.uk. This page currently covers:
- Pothole App (also called Pothole Avoidance) at potholes.wheezydoesit.co.uk
- Projects App (also called Wheezy Projects) at wheezydoesit.co.uk/project_wheezy
By opening or using either app, you agree to this disclaimer. If you do not agree, do not use the app.
1. Free services — no professional advice
Both applications are provided free of charge for general information and personal use only. They are not substitutes for professional advice — whether driving, highway authority information, vehicle inspection, insurance, legal, financial, project-management, or business advice. Nothing on these apps or this website creates a contract for paid services, roadside assistance, guaranteed hazard coverage, or managed project hosting.
2. Pothole App
The following terms apply specifically to the Pothole App. See also the Pothole App guide.
2.1 Community-sourced information
Hazard locations, descriptions, severity ratings, photographs, and “fixed” status are largely submitted by members of the public. We do not guarantee that any report is complete, accurate, current, or still present on the road. Hazards may be missing from the map, shown in the wrong place, duplicated, out of date, or already repaired. You must not rely on the map as your only source of information when driving.
2.2 Driving, alerts, and your responsibility
Features such as live map tracking, route display, proximity tones (including alerts at approximately 100 metres and 50 metres), and vibration are intended as supplementary aids only. They may be delayed, inaccurate, unavailable, or inaudible depending on your device, volume settings, connectivity, GPS signal, weather, traffic, or how you use the app.
- You remain solely responsible for the safe and lawful operation of your vehicle at all times.
- Do not interact with the app in any way that distracts you from the road or breaches traffic laws.
- Alerts are not a guarantee that a hazard exists, or that you will be warned in time to avoid it.
- New potholes and road defects can appear without warning and will not appear on the map until someone reports them.
2.3 Route planning limitations
Route planning uses third-party routing and mapping data. Calculated routes are approximate. The list of hazards “on your route” is based on proximity to the planned path and may include false positives or miss hazards that are still relevant to your journey. Alternative roads may also contain unreported defects.
2.4 Location, GPS, and device permissions
The app may request access to your device location for reporting, tracking, and route features. Location data can be imprecise. We do not store your driven route history or planned journeys on our servers as a matter of design, but your device and browser may cache data locally. See our Privacy Policy for broader website privacy practices.
2.5 User submissions and photographs
If you submit reports or images, you are responsible for ensuring your content is truthful, lawful, and does not infringe others’ rights. Uploaded images may be screened automatically; approval or rejection does not mean we endorse the accuracy of any report. We may remove content, suspend accounts, or limit anonymous reporting without notice where we consider it necessary.
2.6 Report to relevant local authority (future feature)
A planned future feature may help users pass information to a relevant local authority. That feature is not yet available. Submitting a report on the community map does not constitute an official report to any council, highway authority, or emergency service unless and until a dedicated authority hand-off feature is clearly offered and you choose to use it.
2.7 Pothole App accounts and security
Free accounts require activation by email. You are responsible for keeping your login credentials secure and for activity under your account. We take reasonable steps to protect the service but cannot guarantee absolute security.
3. Projects App
The following terms apply specifically to the Projects App. See also the Projects App guide.
3.1 Local storage — your data stays on your device
Projects App stores your project list, notes, attachments, user names, priority levels, and statuses in your browser’s local storage on your device. WheezyDoesit does not upload, host, sync, or back up your project data on its servers. We cannot view, recover, or restore your projects if you lose them.
3.2 You are responsible for your own backup
Because nothing is saved on our servers, you are solely responsible for backing up your data. Use Export Data in the app to download a JSON backup file and keep it somewhere safe. We are not liable for loss of data caused by:
- Clearing browser data or using Clear Data in the app;
- Switching browsers, devices, or operating systems without exporting first;
- Browser or device failure, replacement, or reinstallation;
- Storage limits imposed by your browser or device;
- Importing a file that overwrites data you still needed.
3.3 Import and export
Importing a backup file replaces whatever is currently saved in that browser. We do not verify the contents of import files. You are responsible for checking that a file is correct and current before importing it.
3.4 Attachments and browser limits
File attachments you add are also stored locally in your browser, not on WheezyDoesit servers. Attachment size and quantity may be limited by your browser or device. Large or numerous attachments may affect performance or fail to save without warning.
3.5 No cloud sync or account recovery
There is no login, central account, or cloud sync. If you lose access to the browser or device where your data was stored, we cannot retrieve it for you. Moving work between devices requires your own export and import process.
3.6 General project-management use only
Projects App is a simple personal dashboard tool. It is not enterprise project-management software, legal record-keeping, contract management, or financial planning advice. Do not rely on it as the sole record of obligations, deadlines, or business commitments.
4. No warranty (both apps)
Both applications are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of accuracy, fitness for a particular purpose, data retention, or uninterrupted availability.
5. Limitation of liability
To the fullest extent permitted by applicable law, WheezyDoesit and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from or related to your use of (or inability to use) the Pothole App or Projects App, including but not limited to:
- Vehicle damage, tyre or wheel damage, or mechanical failure (Pothole App);
- Personal injury or death;
- Loss, corruption, or unavailability of project data or attachments (Projects App);
- Financial loss, insurance claims, fines, penalties, or missed deadlines;
- Reliance on map data, alerts, routes, user-submitted content, or locally stored project records;
- Errors, omissions, delays, outages, or unauthorised access.
Nothing in this disclaimer excludes or limits liability that cannot be excluded or limited under the laws of England and Wales (including liability for death or personal injury caused by negligence where such limitation is not permitted).
6. Third-party services
The Pothole App may rely on third-party map tiles, routing APIs, geocoding, and other services. We are not responsible for their availability, accuracy, or terms. Your use of those services may be subject to separate third-party terms. The Projects App runs in your browser and may use standard browser APIs; we are not responsible for browser behaviour, storage quotas, or third-party software on your device.
7. Changes and availability
We may modify, suspend, or withdraw either application or any feature at any time without liability. We may update this disclaimer by posting a new version on this page with a revised “Last updated” date. Continued use after changes means you accept the updated disclaimer.
8. Governing law
This disclaimer is governed by the laws of England and Wales. Courts in England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights in your country of residence.
